Effective: These Terms take effect on the date of their publication on the PPG platform and remain in force until superseded by the next revision published on the same page. The version in force at the time you place an order governs that order.
Pixavince Photography Group (PPG)
These Terms & Conditions ("Shop Terms") govern the purchase of merchandise and physical goods from the PPG Shop at `shop.pixavince-photography.club`.
Pixavince Photography Group ("PPG", "we", "us", "our") is operated by Pixavince Creations, having its registered office at Row House-6, Bhargav Wihar, S.No. 53/1, Near Dnyandeep School, Off Bangalore Bypass, Kudale Baug, Sinhagad Road, Pune, Maharashtra 411041, India.
By placing an order you confirm that you have read, understood and unconditionally accepted these Shop Terms in their entirety.
If you do not agree to any part of these Shop Terms, do not place an order.
1.1 These Shop Terms govern the purchase of merchandise and physical goods from the PPG Shop. They form part of, and must be read together with, the PPG Terms & Conditions that apply across the whole platform.
1.2 Where these Shop Terms differ from the general platform Terms on a matter specific to the purchase of goods, these Shop Terms prevail for that matter.
1.3 These Shop Terms do not govern Workshops, Contests, Challenges, Group Activities or the Level-Up Program. Those are governed by their own Terms published on the platform.
1.4 PPG may amend these Shop Terms at any time. The version published on the platform at the time you place an order governs that order. In the event of any translation, the English version prevails.
2.1 Members only. The Shop is available to logged-in PPG members only. Guest purchase is not available. Browsing the Shop does not require an account; ordering does.
2.2 Account status. Your account must be ACTIVE and in good standing at the time you place an order. PPG may decline or cancel an order placed from an account that is pending, suspended or otherwise not in good standing.
2.3 Accuracy. You are responsible for the accuracy of the account and delivery information you supply, and for keeping your login credentials confidential. PPG relies entirely on this information and accepts no liability arising from information that is false, incomplete, withheld or outdated.
3.1 Product photographs, colours and finishes are shown for reference. Actual colour, texture, print tone and finish may vary from what appears on your screen, because of screen calibration, lighting and the nature of print and fabric production.
3.2 Where an item is printed, handmade or produced in a small batch, minor variation between individual units is normal and is not a defect.
3.3 Sizes, dimensions and weights are approximate and are stated within normal manufacturing tolerance.
3.4 Variation of the kind described in Clauses 3.1 to 3.3 is not a valid ground for exchange.
4.1 All prices are stated in Indian Rupees and are inclusive of applicable taxes unless the product page states otherwise.
4.2 Prices, offers and product availability may change at any time without notice. The price applicable to your order is the price displayed at the time the order is placed.
4.3 Where a product is listed at an incorrect price because of a typographical, system or pricing error, PPG may cancel the affected order even after it has been paid for and confirmed. Clause 11.4 then applies.
4.4 Delivery charges, where applicable, are shown separately at checkout before payment.
5.1 Offer and acceptance. Your order is an offer to purchase. No contract is formed until PPG accepts the order.
5.2 Right to decline. PPG may decline or cancel any order, in whole or in part, at its sole discretion, including where stock is unavailable, where the delivery address falls outside a serviceable area, where an error is detected, or where the order is suspected of being placed in breach of these Shop Terms.
5.3 Confirmation email. An order confirmation email is an acknowledgement of receipt of your order. It is not acceptance of the order.
5.4 Stock. Stock displayed on the platform is indicative. Availability is confirmed only on dispatch.
5.5 Meaning of processing. An order enters processing once payment is confirmed and PPG begins preparing it. Preparing an order includes printing, personalisation, embroidery, framing, assembly, packing, and the procurement or reservation of material or stock for that order. The current stage of an order is shown on the order page in your account.
5.6 When processing begins. Processing may begin immediately after payment is confirmed. For customised, made to order and specially procured items, processing begins as soon as the order is accepted.
6.1 What this covers. Certain items are produced or procured specifically for you and cannot be resold to any other person. These include, without limitation: items carrying a personal name, initials, date, custom text or custom artwork; items produced in a size, colour or specification requested by you; and material or equipment procured specifically for a particular trip, workshop or event at your request.
6.2 No cancellation, no refund. An order for such an item cannot be cancelled, changed or refunded once it has been placed. Sections 11 and 13 apply from the moment the order is accepted, with no cancellation window.
6.3 Your details, your responsibility. You are solely responsible for the accuracy of the details you supply for customisation, including spelling, capitalisation, dates, sizes and any artwork or image you provide. PPG produces the item exactly as per the details submitted and does not verify or correct them.
6.4 An error in the details you supplied is not a defect and is not eligible for exchange under Section 12.
6.5 Rights in supplied material. Where you supply artwork, an image or text for customisation, you confirm that you own it or are permitted to use it, and that it does not infringe the rights of any other person. You indemnify PPG against any claim arising from material you supply. PPG may decline any customisation request at its sole discretion without assigning reason.
7.1 Payment is collected in full at checkout. Orders are not processed on a pay on delivery basis.
7.2 Online payments are processed by a third-party payment gateway. PPG does not receive, store or process your card, UPI or banking credentials. Your use of the gateway is subject to the gateway provider's own terms.
7.3 PPG is not responsible for a payment that fails, is delayed or is declined by your bank or by the payment gateway. Where an amount is debited but the order does not confirm, the amount is ordinarily reversed by your bank or the gateway within their stated timelines. Contact us if it is not.
7.4 An order is treated as paid only when PPG receives confirmation of successful payment from the gateway.
7.5 Payment gateway, bank and convenience charges are borne by you and are not refundable in any circumstance, including where a refund is otherwise payable under Clause 11.4.
7.6 Initiating a chargeback or payment dispute without first raising the matter with us is a material breach. We may recover the disputed amount and all associated costs, and may bar you from future purchase.
8.1 Reward points may be redeemed against an eligible order up to the redemption limit displayed at checkout. The limit depends on your Membership Tier and on the item being purchased. No order can be funded entirely by points.
8.2 Points have no cash value, cannot be encashed, cannot be transferred or gifted, and cannot be reinstated as cash under any circumstance.
8.3 Points redeemed against an order are deducted when the order is placed. Where an order is cancelled under Clause 11.4 or Clause 13.2, the redeemed points are credited back to your account and retain their original expiry. In every other case redeemed points are consumed and are not returned.
8.4 Points earned on a purchase are credited only after payment is confirmed, and are governed additionally by the Rewards & Points terms published on the platform, including expiry.
9.1 Delivery timelines shown on the platform or communicated to you are estimates only. PPG does not guarantee delivery by any particular date.
9.2 PPG is not liable for delay or non-delivery caused by the courier, by an incorrect or incomplete address supplied by you, by your unavailability at the delivery address, or by any cause outside its reasonable control.
9.3 It is your responsibility to supply a complete and correct delivery address and a reachable contact number. Where a shipment is returned to PPG because the address was incorrect or incomplete, or because delivery attempts failed, any cost of re-dispatch is payable by you before the item is sent again.
9.4 Title and risk in the goods pass to you on delivery to the address you supplied, or to any person at that address who accepts the delivery.
9.5 Where an order contains multiple items, PPG may dispatch them separately.
10.1 Inspect the package at the time of delivery. Do not accept a package that is visibly torn, opened, wet or tampered with.
10.2 Unboxing video is mandatory. A continuous, uncut unboxing video is compulsory for any claim. The video must begin before the outer packaging is opened, must clearly show the sealed package and the shipping label, and must run without pause or edit until the item is fully unpacked. A claim submitted without such a video will not be considered, whatever its merit.
10.3 Any claim for an item damaged in transit, an item missing from the shipment, or a wrong item received must be reported to PPG within 48 hours of delivery, together with the video required by Clause 10.2 and clear photographs of the outer packaging, the shipping label and the item.
10.4 A claim reported after 48 hours will not be considered.
11.1 All sales are final. PPG does not offer refunds on Shop purchases for any reason attributable to the customer. This includes change of mind, a duplicate order, an order placed in error, an error in details supplied for customisation, delay in delivery, dissatisfaction with colour, size, fit, print tone or finish, and any variation of the kind described in Section 3.
11.2 Processing is the cut-off. No refund is issued once an order has entered processing, as defined in Clause 5.5. For customised, made to order and specially procured items covered by Section 6, no refund is issued at any stage after the order is placed.
11.3 No refund is issued in cash, to the original payment method, as store credit or as reward points, save as set out in Clause 11.4.
11.4 Where PPG cannot fulfil an order. Where PPG is unable to fulfil an order, for example because stock is unavailable, because a pricing or system error is detected, or because the item cannot be produced, PPG will cancel the order and return the amount received to the original payment method, and any redeemed points will be credited back. This is the only circumstance in which a refund is issued, it is your sole and exclusive remedy, and no further compensation of any kind is payable.
11.5 A refund under Clause 11.4 is processed within a reasonable period after cancellation. The time taken by your bank or the payment gateway to credit the amount is outside the control of PPG.
12.1 Genuine cases only. Exchange is offered solely at the discretion of PPG, and only in a genuine case. A genuine case means, and is limited to:
12.2 In person only. An exchange must be carried out in person at the Pixavince premises. You must bring the item to the address in Clause 17.2 for physical inspection. Courier returns, pickup requests and reverse logistics are not offered and will not be accepted. Any item couriered to PPG without prior written acceptance is sent at your own risk and cost, and PPG accepts no responsibility for it.
12.3 Time limit. An exchange request must be raised within 7 days of delivery. A request raised after 7 days will not be considered.
12.4 Condition of the item. The item must be presented unused, unwashed and undamaged, with all original tags, labels, packaging, accessories and the original invoice intact.
12.5 PPG's decision is final. Whether a case is genuine rests solely with PPG, following physical inspection of the item. That decision is final and binding and is not open to review.
12.6 What an exchange gives you. Where an exchange is approved, the item is replaced with the same item, subject to stock. If the same item is unavailable, PPG may offer an alternative of equal value. No cash, refund or part refund is payable in either case, and no price difference is refunded.
12.7 Exchange is available once per item. An exchanged item cannot be exchanged again.
12.8 Not eligible for exchange. The following are not eligible for exchange under any circumstance: customised, made to order and specially procured items, save where the defect is a manufacturing defect on the part of PPG; items marked final sale, clearance or non-exchangeable; items purchased at a discount or during a promotion, unless the product page states otherwise; and items damaged by misuse, mishandling, improper washing, storage or normal wear.
13.1 An order for a customised, made to order or specially procured item cannot be cancelled at any stage, as set out in Clause 6.2.
13.2 Request, not a right. For all other items, you may raise a cancellation request through the order page in your account only before the order enters processing. A cancellation request is not a cancellation. Acceptance of the request is at PPG's sole discretion. Where a request is accepted, the amount received is returned to the original payment method and any redeemed points are credited back.
13.3 Once an order has entered processing it cannot be cancelled, whether or not it has been dispatched.
13.4 Refusing delivery of a dispatched order is not a cancellation and does not entitle you to a refund. Section 11 continues to apply.
14.1 All designs, artwork, photographs, prints, logos, product names and Shop content belong to Pixavince Creations or its licensors and are protected by law.
14.2 Goods purchased from the Shop are for personal use only. You shall not resell, redistribute, reproduce or use them for any commercial purpose, and shall not reproduce any design or artwork appearing on them.
15.1 To the maximum extent permitted by law, the total liability of Pixavince Creations in connection with an order, however arising, is limited to the amount actually received by PPG for the item concerned.
15.2 PPG is not liable for any indirect, incidental or consequential loss, including loss of opportunity, loss of profit, or any loss arising from delay in delivery or from an item being unavailable.
15.3 Save as expressly stated in these Shop Terms, all warranties, conditions and representations, whether express or implied, are excluded to the extent permitted by law.
15.4 Nothing in these Shop Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of India. Where any exclusion or limitation is held unenforceable, the remaining provisions continue in full force and liability is limited to the maximum extent permitted by law.
16.1 These Shop Terms are governed by the laws of India.
16.2 Raise any concern with us at contact@pixavince.com. We will acknowledge within 7 working days and respond within 30 working days.
16.3 Any dispute not resolved within 30 days of written notice shall be referred to arbitration by a sole arbitrator appointed by Pixavince Creations under the Arbitration and Conciliation Act, 1996, seated at Pune, Maharashtra, in English. Subject to that, the courts at Pune, Maharashtra have exclusive jurisdiction. Claims must be brought individually; no class or representative proceeding is permitted.
17.1 PPG may amend these Shop Terms at any time. The version published on this page at the time you place an order is the version that governs that order. Continued use of the Shop after an amendment constitutes acceptance of it.

17.3 Visits for exchange inspection are by prior appointment only. Contact us before travelling. PPG is under no obligation to inspect an item presented without a prior appointment.
